History and key elements of Art. 16 Right to Rectification:
- Right to rectification is associated with the Art. 5(1)(d) data protection principle of accuracy which states that data shall be “accurate and, where necessary, kept up to date“.
- Art. 16 states that individuals have the right to rectification of inaccurate data concerning them. Pursuant to Art. 16, individuals can provide “a supplementary statement” to controllers to have their incomplete data completed.
- Art. 19 places an obligation on the controller to communicate data rectification to data subjects.
- The right to rectification is closely associated with the Art. 17 right to erasure (right to be forgotten) discussed here.
